2. Subject matter
Lucid Dream Retreats organises residential retreats for adults, in small groups, combining accommodation, meals and a structured programme of activities for personal development and the exploration of states of consciousness.
The services specifically included, the dates, duration, features of the accommodation and price are indicated on the corresponding page and in the individual booking confirmation.
3. Participants
Participation is permitted exclusively to persons aged 18 or over.
Each retreat will have a maximum of 8 participants. The retreat will only take place if there are at least 5 participants.
If the minimum number is not reached, Lucid Dream Retreats may cancel the retreat by notifying the participant up to 21 days before the start of the retreat.
In that case, all amounts paid by the participant will be refunded in full, unless the participant expressly accepts a transfer to another retreat.
4. Booking process
The booking process comprises:
- a contact request;
- an initial consultation;
- assessment of suitability for participation;
- confirmation of availability and acceptance of participation by Lucid Dream Retreats;
- provision of the contractual conditions;
- acceptance by the participant;
- payment of the advance.
A request for information or the holding of the initial consultation does not in itself constitute a binding booking.
The booking becomes binding once Lucid Dream Retreats has confirmed participation, the participant has accepted the contract and the first payment due has been received.
5. Suitability assessment and contraindications
Before participation is confirmed, an initial consultation is held in order to assess the suitability and safety of participation.
The participant undertakes to provide complete and truthful information about circumstances relevant to that assessment.
Where there is a physical, psychological, psychiatric, pharmacological or other contraindication that makes participation unsuitable or unsafe, participation cannot be confirmed.
The health information discussed during that consultation is not recorded, audio-recorded or stored.
The participant must not interrupt, reduce or alter prescribed medication for the purpose of taking part in the retreat without the guidance of the health professional responsible for the treatment in question.
6. Nature of the retreat
The services of Lucid Dream Retreats do not constitute medical, psychiatric, psychological or psychotherapeutic treatment.
The retreat does not replace care provided by qualified health professionals.
Lucid Dream Retreats does not guarantee any specific therapeutic, medical, psychological, spiritual or personal development outcome.
7. Accommodation
The accommodation is provided in an establishment operated by an external operator duly responsible for the applicable authorisations and registrations, including the corresponding Alojamento Local registration where legally required.
The specific features of the accommodation and its details are made available to the participant before the contract is concluded.
8. Price
The price applicable to each retreat is that indicated on the website at the time of booking and confirmed in the contractual documentation.
All prices presented to the consumer include the legally applicable taxes.
Any optional service not included in the price will be clearly identified before it is contracted.
9. Payment
Unless otherwise agreed in writing, payment is made as follows:
- 30 % of the total price at the time the booking is confirmed;
- 70 % of the total price up to 30 days before the start of the retreat.
For bookings confirmed less than 30 days before the start of the retreat, the total price is due at the time of confirmation.
Payments may be made by bank transfer or PayPal.
10. Cancellation by the participant
The participant may cancel the booking at any time before the start of the retreat by notice in writing.
Save where the applicable mandatory legislation provides for a different solution, the following maximum cancellation fees apply:
| Time of cancellation | Maximum fee |
|---|---|
| More than 60 days before the start | 10 % of the total price |
| 31 to 60 days | 25 % |
| 15 to 30 days | 50 % |
| 8 to 14 days | 70 % |
| 7 days or less, or non-attendance | 90 % |
The cancellation fees may not exceed the reasonably justifiable losses associated with the cancellation. In determining the amount actually retained, account will be taken of the cost savings resulting from the cancellation and of the revenue obtained by reallocating the place.
If the place is filled by another participant, the fee will be reduced to the extent corresponding to the costs and losses actually avoided.
11. Transfer of the booking
The participant may request the transfer of their booking to another person.
The substitute person must meet the requirements for participation and complete the corresponding suitability assessment.
Only the additional costs actually resulting from the transfer may be charged, to the extent legally permissible.
12. Cancellation by Lucid Dream Retreats
Lucid Dream Retreats may cancel the retreat where:
- the minimum number of five participants is not reached, provided that notice is given up to 21 days before the start;
- unavoidable and extraordinary circumstances prevent the retreat from taking place;
- there is another ground permitted by the applicable legislation.
In those cases, the amounts owed to the participant will be refunded in full within the applicable legal period.
The participant may, as an alternative, voluntarily accept the transfer of the amount paid to another retreat.
13. Changes to the programme
Minor changes to timings, the sequence of activities, facilitators or elements of the programme may occur where necessary for organisational, weather-related or safety reasons, provided that they do not significantly alter the nature or the value of the services contracted.
Significant changes are subject to the participant’s rights provided for in the applicable legislation.
14. Psilocybin and controlled substances
Psilocybin is not included in the price of the retreat and is not sold, stored, transported or supplied by Lucid Dream Retreats.
Any activity relating to substances subject to legal control must fully comply with the applicable Portuguese legislation.
Any information concerning third parties or external possibilities relating to obtaining a substance may only be provided if and to the extent that this is legally permissible.
No provision of these Terms and Conditions is to be interpreted as authorisation, encouragement or a guarantee of the lawfulness of the acquisition, possession, supply or use of any controlled substance.
15. Conduct and safety
The participant undertakes to respect the reasonable safety rules, the other participants, the team, the retreat venue and the accommodation.
Lucid Dream Retreats may discontinue participation where a participant’s conduct represents a serious risk to themselves, to third parties or to the safe running of the retreat.
The financial consequences of such a termination will be assessed in accordance with the specific circumstances and the applicable legislation, mandatory consumer rights not being excluded.
16. Personal insurance and the provider’s insurance
The participant is advised to take out personal travel, health and cancellation insurance appropriate to their circumstances.
This recommendation does not replace any insurance that Lucid Dream Retreats is legally obliged to take out.
17. Photographs, videos and testimonials
The use of identifiable images, videos or testimonials of participants for advertising or communication purposes will only take place with the separate consent of the participant.
Refusal of that consent does not affect the right to take part in the retreat.
18. Intellectual property
The materials and content made available by Lucid Dream Retreats are intended for the participant’s personal use.
They may not be reproduced, distributed or used commercially without prior authorisation.
19. Complaints
Questions or complaints may be sent to geral@lucid-dreams.pt.
Where legally applicable, the Electronic Complaints Book is also available.
20. Alternative dispute resolution
The consumer may refer the matter to the competent Alternative Consumer Dispute Resolution body.
For Alcanena: CNIACC - Centro Nacional de Informação e Arbitragem de Conflitos de Consumo.
21. Applicable law
The contract is governed by Portuguese law.
No provision of these Terms and Conditions excludes or limits mandatory rights conferred on the consumer or traveller by the applicable legislation.
22. Language of the contract
Lucid Dream Retreats makes information and contracts available in Portuguese, German and English.
The individual contract will be concluded in the language chosen and made available to the participant during the booking process.
The language version delivered to and accepted by the participant constitutes the version applicable to the respective contract.
23. Form and retention of the contract
The contract and the relevant information are made available to the participant by means that allow them to be retained and reproduced.
